
REGULATIONS FOR DONATION TO THE FOUNDATION

DONATION POLICY
§1. Definitions
- Portal - the website dobrosieniesie.pl and all of its functionalities.
- Organization – Service provider within the meaning of the Act of July 18, 2002, on the provision of electronic services, i.e., DOBRO SIĘ NIESIE Foundation, KRS 0000935117, REGON: 520550324, NIP: 7831846855, with its registered office at ul. Hugona Kołłątaja 84, 61-421 Poznań, accepting donations using the services of the Payment Operator for statutory purposes.
- Terms and Conditions – this document specifying the rules for making donations through the Portal.
- User – a natural person with full legal capacity who uses the services offered through the Portal or makes a donation to the Organization through it.
- Donor – User who made the Donation.
- Payment operator – PayPro S.A. (Przelewy24), ul. Pastelowa 8, 60-198 Poznań, entered into the register of entrepreneurs of the National Court Register (KRS) under number 0000347935, handling electronic payments for the Organizer.
- Donation – funds transferred by the User to the Organization for statutory purposes.
- One-time donation – a single payment made by the Donor.
- Recurring donation (subscription) – a recurring payment made automatically at set intervals (monthly, quarterly, or annually) using a stored payment card token.
- Card token - encrypted payment card identifier stored by the Payment Operator, enabling recurring payments without the need to re-enter card details.
- Donor Panel – Portal functionality enabling the Donor to manage their recurring subscriptions.
§2. General Provisions
- The portal is used to raise funds for the Organization's statutory purposes and to communicate with Donors and other Users.
- The User is obliged to read these Terms and Conditions before starting to use the Portal. Use of the Portal is equivalent to accepting its content.
- The user is required to comply with the provisions of the Terms of Service.
- The Organization makes the Regulations available on its website in a manner that allows anyone to access, download, and save them in electronic form.
§3. One-time donation
- When a user transfers financial resources to the Organization, this constitutes a donation within the meaning of Article 888 of the Civil Code.
- A donation agreement consists of transferring a free monetary benefit to the Organization at the Donor's expense.
- Making a financial transfer fulfills the conditions of Article 890 §1, second sentence of the Civil Code, which means the gift is valid and effective despite not being made in the form of a notarial deed.
- The minimum one-time donation amount is PLN 1.00 (one zloty).
- After making a donation, the Donor receives a confirmation at the provided email address.
§4. Recurring Donation (Subscription)
- The donor can decide to regularly support the Organization by establishing a recurring donation.
- Recurring donations are made on the following cycles:
- monthly – payment is debited every month,
- quarterly - payment charged every 3 months,
- annual – payment collected every 12 months.
- The minimum amount for a recurring donation is PLN 1.00 (one zloty).
- The first payment is charged when the subscription is set up. Subsequent payments are charged automatically according to the selected cycle.
- Recurring donations are made exclusively using a payment card (debit or credit).
- Establishing a recurring donation requires consent to save the payment card token by the Payment Operator for future payments.
- The organization does not store full payment card data (card number, expiry date, CVV code). This data is processed exclusively by the Payment Operator in accordance with PCI DSS security standards.
- The donor receives an email confirmation after each recurring payment is processed.
§5. Revocation of a cyclic donation
- The donor may cancel a recurring donation at any time without giving a reason.
- Subscription cancellation is possible via:
- Donor Panel available on the Portal,
- contact email at: maciej@dobrosieniesie.pl,
- Telephone contact with the Organization.
- Subscription cancellation results in:
- discontinuing further payments,
- removal of the payment card token from the Payment Operator's system.
- Subscription cancellations do not affect the validity of donations already made – they are non-refundable.
- The organization confirms the subscription cancellation via email.
- In case of problems with canceling the subscription, the Donor may also contact the Payment Operator (Przelewy24) directly or their bank to block recurring payments.
§6. Donor Panel
- Donors using recurring donations have access to the Donor Dashboard.
- Access to the Donor Panel is granted by providing an email address to which a one-time access link, valid for 24 hours, is sent.
- In the Donor Panel, a Donor can:
- browse your deposit history,
- check the status of active subscriptions,
- cancel recurring subscription.
- The organization does not store passwords for the Donor Panel – each access requires verification via email.
§7. Technical Requirements
- For effective use of the Portal, the User should meet the following requirements:
- having a device that allows internet access,
- using a current web browser that supports JavaScript and cookies,
- Having an active email address.
- Costs associated with Internet access are borne by the User according to their service provider's tariff.
- To make a card payment, you need to have a valid payment card supported by the Payment Operator.
§8. Conclusion of the Agreement
- The agreement is concluded upon commencement of the use of the Portal's functionalities.
- Entering into an agreement is voluntary.
- The Organization, through the Portal, allows - using the Payment Operator - the transfer of a donation to the Organization.
- The organization does not charge commission or additional fees from Donors. Any payment processor fees will not be charged to the Donor.
§9. Payment Security
- All payments are processed through the Payment Operator (Przelewy24), which has the status of a National Payment Institution supervised by the Polish Financial Supervision Authority.
- The payment operator adheres to the highest security standards, including PCI DSS certification.
- Payment data transmission is encrypted with the SSL/TLS protocol.
- The organization warns of the dangers associated with using electronic services and appeals for caution and reporting any security concerns to: biuro@dobrosieniesie.pl.
§10. Personal Data Protection
1. The controller of the Donor’s personal data is Fundacja Dobro się Niesie, with its registered office in Poznań (ul. Hugona Kołłątaja 84, 61-421 Poznań, KRS 0000935117, NIP 7831846855, REGON 520550324).
2. Contact for data protection matters: biuro@dobrosieniesie.pl.
3. The provision of personal data is voluntary, but necessary for the execution of the donation and for communication with the Donor.
4. Purposes of personal data processing:
a) Execution of the donation agreement - receiving payment, issuing confirmation, subscription management;
b) sending personal thank-you notes from the Foundation's President and information on how the donated funds were used;
c) sending impact reports (including the annual „Good Story” report, newsletter, and information about the Foundation's activities);
d) sending invitations to events organized by the Foundation;
e) performing legal obligations incumbent upon the Foundation (accounting, reporting);
f) establishing, investigating, and defending claims.
5. Legal basis for processing (Article 6(1) GDPR): a) Article 6(1)(b) GDPR – for the purpose referred to in point 4(a) (performance of a contract); b) Article 6(1)(a) GDPR (voluntary consent of the Donor given by accepting these Regulations) – for the purposes referred to in point 4(b), (c), (d); c) Article 6(1)(c) GDPR – for the purpose referred to in point 4(e) (legal obligation); d) Article 6(1)(f) GDPR – for the purpose referred to in point 4(f) (legitimate interests of the Controller).
6. Scope of processed data: first name, last name, email address, phone number (optional), city, donation details (amount, date, frequency).
7. Data recipients: Payment operator (PayPro S.A. — Przelewy24), entities providing accounting and legal services to the Foundation, e-mail marketing platform provider (MailerLite Limited), state authorities in case of legal obligation.
8. Data retention period: 5 years from the end of the calendar year in which the donation was made – or longer if necessary to protect the Foundation against claims.
9. Donor Rights (Articles 15-22 GDPR):
a) access to your personal data;
b) correction of incorrect or incomplete data;
c) erasure of data („right to be forgotten”);
d) restriction of processing;
e) data transfer;
f) objection to processing (in particular for marketing purposes);
g) withdrawal of consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
10. Withdrawal of consent for communication referred to in point 4(b), (c), (d) is possible at any time - without giving a reason - by means of:
a) clicking the „unsubscribe” link in every email you receive;
b) sending a message to: maciej@dobrosieniesie.pl;
c) by submitting a written application to the Foundation's registered office.
11. Withdrawal of consent for marketing communication does not affect the Foundation's obligation to send confirmations required by tax law (payment confirmations).
12. The exercise of the rights referred to in points 9 and 10 is carried out by sending an email to: biuro@dobrosieniesie.pl. The deletion of personal data results in the automatic cancellation of an active subscription.
13. The Foundation does not use automated decision-making or profiling within the meaning of Article 22 of the GDPR.
14. The donor has the right to lodge a complaint with the supervisory authority — the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw).

§11. Complaints
- The user has the right to file a complaint at: biuro@dobrosieniesie.pl.
- The complaint should include:
- User contact details,
- problem description,
- expected way of solving.
- The organization will consider the claim within 14 days of receipt.
- A response to the complaint will be sent to the email address from which the inquiry was submitted.
- Complaints regarding payments can also be directed directly to the Payment Operator (Przelewy24).
§12. Returns
- Donations are generally non-refundable, as they constitute a voluntary contribution to the Organization's statutory objectives.
- In exceptional cases (e.g., a technical error resulting in a double charge), the Organization will consider refund requests on an individual basis.
- Requests for a refund should be submitted immediately to biuro@dobrosieniesie.pl, providing transaction details.
§13. Changes to the Regulations
- The organization reserves the right to change the Terms and Conditions.
- Users will be informed of changes to the Regulations at least 14 days before they come into effect by posting a notice on the Portal.
- Donors with active recurring subscriptions will be additionally informed of significant changes via email.
- Continued use of the Portal after the changes take effect signifies your acceptance of them.
§14. Final Provisions
- The regulations shall enter into force on the date of their publication on the Portal.
- In matters not regulated by these Regulations, Polish law shall apply, in particular the Civil Code and the Act on the provision of electronic services.

- The regulations are intended to ensure transparency and security in the cooperation between Donors and the Organization.
